Shoddy Foundations and Shoddy Homebuilders
Want to buy a new home? Or build your dream home? Well, you better do your homework because Texas laws are designed to protect shoddy homebuilders. And one of the areas of shoddy work is the foundation – minimally functional foundations that are almost guaranteed to fail in short order.
Now there are some good home builders in Texas. But you’ll have to work to find them, interview them, vet them, and have your lawyer conduct background checks. And then you might want to knock on some doors in the neighborhood where you want to live. Or maybe knock on a lot of doors.
How does this happen in the great state of Texas? Well, during every legislative session in Texas the shoddy homebuilders and their lawyers and lobbyists swoop into Austin to cajole and intimidate our great lawmakers. These are the same lawmakers that were elected by the people and for the people to protect the people. The shoddy homebuilders and their paid professionals bully these legislators into writing laws that allow them to build inferior homes and giving the homeowner little recourse.
One of the most offensive of these laws is the requirement of homeowners to use Mandatory (Forced) Arbitration, which strips them of their right to sue the shoddy homebuilder in a court of law. Mandatory Arbitration is not a time or money saver but rather an organized racket that crushes the homeowner into financial and emotional submission and defeat.
